1) In 2003, the public generally assumed (re Bush, Cheney, Rice, et al.) thatr Hussein had WMDs. Since then, a number of issues have cropped up, not least of which is the utter absence of the WMDs and the vindication of Scott Ritter. Absent a direct threat to the US, preemptive war is indeed a violation of the Geneva and Hague Conventions as well as the UN Charter, not to mention the Kellogg-Briand Pact, which, having been ratified by the US Senate, does indeed have the force of law in the US.

2) His job is to "uphold and defend the Constitution." He's phrased his opposition in just those terms by citing the war as "illegal" and "immoral." A colleague of mine at an unspecified government agency used to demonstrate against the war in VN (illegally in his naval reserve uniform no less) back in the '70s for just the same reason. A staunch libertarian, he believed that Congress had never authorized the conflict. Didn't seem to affect his polygraphed security clearance any.

My question is when did he first attempt to resign his commission: before or after he learned he would be deployed?
